Wrongful Arrest in California: Does a Dismissed Charge Mean the Arrest Was Unlawful?

A criminal charge that gets dismissed can feel like proof that the arrest should never have happened. After being arrested, booked, and possibly held, many people reasonably ask whether the dismissal means the police acted unlawfully.

The answer is not always yes. A dismissed charge and an unlawful arrest are two different questions. A case can be dropped for many reasons, while the legality of an arrest depends largely on what the officers knew when they made it.

That does not mean a dismissal should be ignored. Facts that led to the dismissal may point to problems with the arrest, and the records created by the arrest may still need attention.

For people in Los Angeles and throughout California, 첫 번째 단계는 종종 실용적입니다.: understand the difference, preserve what you have, and identify which records may need to be requested.

What Makes an Arrest Lawful in California?

An officer may arrest a person with a warrant or, in certain situations, without one. 아래에 캘리포니아 형법 섹션 836, an officer may generally make a warrantless arrest when there is probable cause to believe the person committed a public offense in the officer’s presence, or probable cause to believe the person committed a felony, even if the officer did not see it happen.

Probable cause generally means the facts known to the officer would lead a reasonable person to believe the person arrested committed a crime. It requires more than a hunch, but it does not require proof beyond a reasonable doubt.

Does a Dismissed Charge Mean the Arrest Was Unlawful?

Not by itself. Courts generally look at the information the officer had at the time of the arrest, not at what happened afterward.

The Ninth Circuit applied this principle in a recent decision involving a man later cleared of the charges. The court explained that later evidence pointing in a different direction did not negate probable cause that existed when he was arrested. The decision also notes that a person bringing a false arrest claim must show there was no probable cause for the arrest.

Charges can be dismissed for reasons unrelated to the arrest, such as a witness who stops cooperating, evidence that a prosecutor decides is insufficient, or a charging decision made later in the case.

The offense listed at booking does not control either. A Ninth Circuit decision reiterated that an arrest is lawful if officers had probable cause for any offense, not only the one they cited at the time.

California law adds another layer. 아래에 Penal Code section 847, officers are not civilly liable for false arrest when the arrest was lawful, or when they had reasonable cause at the time to believe it was lawful.

When Can an Arrest Be Unlawful Even if the Charge Is Dismissed?

A dismissal can prompt a closer look at what officers actually knew. Facts that may deserve legal review include:

  • The police report describes conduct that available video or witnesses contradict
  • Officers made a warrantless arrest without facts supporting probable cause
  • The arrest relied on a witness account officers had reason to doubt
  • Officers disregarded information showing no crime occurred or pointing to someone else
  • The stop or detention that led to the arrest was itself unjustified

이러한 사실만으로는 책임이 성립되지 않습니다., and the dismissal alone does not either. But together they can help identify whether the arrest, the stop that preceded it, or both should be reviewed.

What Is the Difference Between False Arrest and Malicious Prosecution?

The two claims are related, but they look at different moments.

에이 false arrest claim focuses on the arrest itself and whether officers had probable cause when they made it.

에이 malicious prosecution claim focuses on the decision to start or continue the criminal case, and generally involves charges that ended in the accused person’s favor.

A dismissal is more directly connected to malicious prosecution, but not every dismissal qualifies, and each claim has its own requirements. A dismissal may still be useful context when reviewing a false arrest.

What Should You Save After an Arrest That Led to a Dismissed Case?

Start with documents and details that identify the arrest, the agency, and the court case.

Useful records may include:

  • Arrest report, citation, or booking paperwork
  • 법원 문서, including the complaint, minute orders, case number, and dismissal order
  • Dates and times of the arrest, booking, release, and dismissal
  • 이름, 배지 번호, and agency of the officers involved
  • Video from body-worn cameras, dash cameras, phones, doorbell cameras, or businesses
  • Names and contact information for witnesses
  • Bail, bond, or release paperwork and receipts

Can You Seal an Arrest Record After a Dismissal?

Possibly, and this is a separate question from whether the arrest was lawful.

California law allows a person who was arrested but not convicted to petition to seal arrest records. A finding of factual innocence under Penal Code section 851.8 can lead to sealing and destruction of arrest records, but it requires showing that no reasonable cause existed to believe the person committed the offense.

Eligibility depends on the case. A criminal defense attorney can explain these options. Because arrest records may also matter as evidence, it is worth asking about timing before any records are sealed or destroyed.

Is There a Deadline to Take Action After a Dismissal?

예, and the dismissal date may not be the starting point.

Certain California state-law claims against public entities generally require a government claim within six months after the claim accrues under 정부 코드 섹션 911.2. Determining when a claim accrues, and whether the date of the arrest, release, or dismissal matters, requires a case-specific review.

연방 민권 주장에는 절차적 요구 사항이 다릅니다.. Do not assume that a dismissal extends or restarts the time to act. If charges are still pending, speak with your criminal defense attorney as well.
